{"id":994,"date":"2018-04-19T14:36:55","date_gmt":"2018-04-19T19:36:55","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=994"},"modified":"2021-09-30T13:38:51","modified_gmt":"2021-09-30T18:38:51","slug":"waiver-of-appeal-in-texas-divorce-cases","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/waiver-of-appeal-in-texas-divorce-cases\/","title":{"rendered":"Waiver of Appeal in Texas Divorce Cases"},"content":{"rendered":"<p>Texas divorce attorneys know that even when a divorcing couple reaches a settlement agreement, there still may be issues that are in dispute.\u00a0 Settlement agreements sometimes include provisions that the parties waive the right to appeal.\u00a0 In a <a href=\"https:\/\/cases.justia.com\/texas\/fourth-court-of-appeals\/2018-04-17-00326-cv.pdf?ts=1524054477\" target=\"_blank\" rel=\"noopener noreferrer\">recent case<\/a>, a husband attempted to appeal a final divorce decree despite a waiver of appeals in the settlement agreement.<\/p>\n<p>When the couple filed for divorce, they owned several piece of property.\u00a0 They had two parcels of the wife\u2019s family ranch, one that she owned as separate property.\u00a0 They purchased the second parcel from the wife\u2019s brother and financed it through a loan secured by her separate property parcel.\u00a0 They also took out a second loan on the wife\u2019s property to pay for divorce attorney\u2019s fees.<\/p>\n<p>The parties eventually entered into an \u201cInformal Settlement Agreement.\u201d\u00a0 Pursuant to this agreement, the husband would receive the family homestead and the wife would receive both parcels of her family ranch, with the husband paying the two loans. As part of the agreement, the parties waived their right to appeal or move for a new trial.
