What if in Texas?"},"content":{"rendered":"<p style=\"text-align: justify\">Many have heard the story of Devon Still and his daughter Leah\u2014a four year old in a battle with cancer. Recently, it was reported that Devon Still ex, and mother of Leah, is accusing Mr. Still of failing to pay child support for many months.\u00a0 The question that many are asking is whether Mr. Still\u2019s financial support for his daughter outside of \u201cchild support\u201d would offset his child support obligation.\u00a0 If this occurred in Texas, what would a Court say?<\/p>\n<p style=\"text-align: justify\">In Texas, the answer is most likely no, and Mr. Still would be facing jail time for contempt of Court if he failed to pay court-ordered child support.\u00a0 Hypothetically, Assume that Mr. Still is under an order to pay child support in Texas.\u00a0 Would he have any defense for his failure to pay (other financial support, medical support, etc.)?\u00a0 The Texas Family Code has specific <a title=\"Texas Family Code - Child Support\" href=\"http:\/\/law.justia.com\/codes\/texas\/2013\/family-code\/title-5\/subtitle-b\/chapter-154\/\" target=\"_blank\" rel=\"noopener noreferrer\">defenses<\/a>\u00a0for the failure to pay child support.\u00a0 These include voluntary relinquishment by the obligee (party owed support) to the obligor (party responsible for paying support).\u00a0 Basically, if the obligee gives the obligor more time than ordered by the Court, the obligor can have a defense to failure to pay child support if he also provided actual support of the child.\u00a0 In Mr. Still\u2019s case, if he had possession of his daughter full-time due to the fact that her mother voluntarily relinquished their daughter to Mr. Still, then he would have an affirmative defense to the Court\u2019s enforcement of his child support obligation. <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/devon-still-outstanding-child-support\/#more-62\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Many have heard the story of Devon Still and his daughter Leah\u2014a four year old in a battle with cancer.
