{"id":54,"date":"2014-02-05T18:25:33","date_gmt":"2014-02-06T00:25:33","guid":{"rendered":"http:\/\/texasdivorceattorneyblog.lawblogger.net\/?p=37"},"modified":"2014-02-05T18:25:33","modified_gmt":"2014-02-06T00:25:33","slug":"sex-divorce-texas","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/sex-divorce-texas\/","title":{"rendered":"Same Sex Divorce In Texas"},"content":{"rendered":"<p><a style=\"line-height: 1.5em\" href=\"http:\/\/www.statutes.legis.state.tx.us\/Docs\/CN\/htm\/CN.1.htm#1.1\" target=\"_blank\" rel=\"noopener noreferrer\">Article 1 Section 32 of the Texas Constitution<\/a><span style=\"line-height: 1.5em\"> states that \u201cMarriage in this state shall consist only of the union of one man and one woman\u2026 this state may not create or recognize any legal status identical or similar to marriage.\u201d\u00a0 Also, under the Texas Family Code, the Legislature of Texas enacted section 6.204 which states that same-sex marriage and civil unions are void as they are against the public policy of Texas.\u00a0 This section further states that same-sex marriage and civil unions from other jurisdictions are void as well.\u00a0 The United States Supreme Court recently ruled that the Defense of Marriage Act was unconstitutional\u2014effectively making same-sex marriage recognized on the federal level.\u00a0 So if a same-sex married couple gets married in a state that recognizes same-sex marriage, then moves to Texas, how does this couple get divorced?\u00a0 The couple would be married in the eyes of the federal government (for example in filing an income tax return with the IRS), but would not be married in the eyes of the state of Texas.\u00a0 Divorce is an issue that is handled on the state level.\u00a0 State Courts, not Federal Courts, grant divorces.<\/span><\/p>\n<p>So if a member of a same-sex couple who was married in a state that recognizes same-sex marriage wishes to get divorced while living in Texas, what can he or she do?\u00a0 That is the question that is currently in front of the Supreme Court of Texas.\u00a0 The Court faces a tricky legal question because granting a divorce in Texas requires the existence of a valid marriage.\u00a0 If the Court chooses to grant the divorce, then the Court would be acknowledging a valid marriage which violates the Texas Constitution.\u00a0 On the other hand, if the Court were to deny the divorce, then the same-sex couple would, against their wishes, still be married in the eyes of the federal government and states that recognize same sex marriage.<br \/>\nThe same-sex married couples\u2019 options would be file a suit in Texas to declare the marriage void\u2014which tells other states and the federal government that the parties were never validly married (even though they were validly married in the state where their same-sex marriage was granted)\u2014or, establish residency and obtain a divorce in another state. <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/sex-divorce-texas\/#more-54\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Article 1 Section 32 of the Texas Constitution states that \u201cMarriage in this state shall consist only of the union of one man and one woman\u2026 this state may not create or recognize any legal status identical or similar to marriage.\u201d\u00a0 Also, under the Texas Family Code, the Legislature of Texas enacted section 6.204 which [&hellip;]<\/p>\n","protected":false},"author":2,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[4],"tags":[5,6],"class_list":["post-54","post","type-post","status-publish","format-standard","hentry","category-divorce","tag-divorce-2","tag-same-sex-marriage"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v25.7 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Same Sex Divorce In Texas &#8212;
