{"id":3118,"date":"2025-11-27T09:48:55","date_gmt":"2025-11-27T15:48:55","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=3118"},"modified":"2025-12-01T09:49:55","modified_gmt":"2025-12-01T15:49:55","slug":"texas-court-improperly-granted-summary-judgment-that-separate-property-was-converted-to-community-property","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-improperly-granted-summary-judgment-that-separate-property-was-converted-to-community-property\/","title":{"rendered":"Texas Court Improperly Granted Summary Judgment that Separate Property Was Converted to Community Property"},"content":{"rendered":"<p>Characterization of property can be a significant issue in a Texas divorce.\u00a0 The Texas Family Code includes a presumption that property owned by a spouse at the time of divorce is community property, but this presumption can be overcome by clear and convincing evidence the property is the spouse\u2019s separate property.\u00a0 Separate property includes property owned by a spouse before the marriage and property inherited during the marriage.\u00a0 In a recent case, a former husband <a href=\"https:\/\/cases.justia.com\/texas\/third-court-of-appeals\/2025-03-24-00478-cv.pdf?ts=1763128080\" target=\"_blank\" rel=\"noopener\">challenged<\/a> the trial court\u2019s award of certain property to the wife after declaring it had become community property.<\/p>\n<p>The husband owned certain real property before the parties married in July 2020.
