Tex. Fam. Code \u00a7 156.101(a). The Texas Supreme Court set forth factors to be considered in relocation cases in <em>Lenz v. Lenz<\/em>. In a <a href=\"https:\/\/cases.justia.com\/texas\/eighth-court-of-appeals\/2025-08-24-00335-cv.pdf?ts=1763213835\" target=\"_blank\" rel=\"noopener\">recent case<\/a>, a mother appealed a court\u2019s decision not to remove a geographic restriction to allow her to move with the child to live with her new husband in England.<\/p>\n<p>Under the divorce decree, the mother had the exclusive right to designate the child\u2019s primary residence within El Paso County.<\/p>\n<p>The mother started dating a goalkeeper coach for an English Premier League soccer team.\u00a0 She told the father she planned to move to England and he petitioned for modification to be named primary managing conservator with the exclusive right to designate the child\u2019s primary residence. The mother filed a counter-petition seeking removal of the geographic restriction.<\/p>\n<p>The mother testified she quit her job and her fianc\u00e9 would support her and the child. She said she intended to move regardless of the court\u2019s decision.
