{"id":3069,"date":"2025-08-22T08:41:04","date_gmt":"2025-08-22T13:41:04","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=3069"},"modified":"2025-08-22T08:44:01","modified_gmt":"2025-08-22T13:44:01","slug":"real-estate-lost-separate-property-character-when-transferred-to-business-entity","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/real-estate-lost-separate-property-character-when-transferred-to-business-entity\/","title":{"rendered":"Real Estate Lost Separate Property Character When Transferred to LLC"},"content":{"rendered":"<p>Real estate investments can lead to complex issues for property division in a Texas divorce, especially if there are co-owners or business entities involved.\u00a0 A former husband recently <a href=\"https:\/\/cases.justia.com\/texas\/seventh-court-of-appeals\/2025-07-25-00011-cv.pdf?ts=1755608130\">challenged<\/a> the property division in his divorce, which characterized certain property as his wife\u2019s separate property and awarded his father-in-law a 50% interest in a piece of real estate.<\/p>\n<p>The parties moved to Texas from the U.K., intending to purchase real estate in Austin.\u00a0 In 2018, the wife\u2019s parents gave her about \u00a3250,000, documented as a gift in a letter.\u00a0 The wife put \u00a3214,000, which totaled a little over $248,000, into a joint account.\u00a0 The funds were used for 97.19% of the purchase price of a property identified by the court as \u201cthe Webberville property.\u201d\u00a0 The purchase and deed were in only the husband\u2019s name based on advice from an immigration attorney.<\/p>\n<p>The parties purchased \u201cthe Gunter property\u201d with the wife\u2019s father in late 2019.\u00a0 They did not have a written contract regarding the co-ownership, but the wife\u2019s father testified they agreed he would put 50% down and own 50% of the property.\u00a0 He had signed a letter in November of that year, however, stating the funds he put toward the purchase were a gift with no expectation of repayment.
