{"id":3065,"date":"2025-08-14T06:12:12","date_gmt":"2025-08-14T11:12:12","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=3065"},"modified":"2025-08-14T06:12:12","modified_gmt":"2025-08-14T11:12:12","slug":"court-finds-texas-prenup-did-not-waive-reimbursement-claims-costing-wife-over-200000-in-divorce","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/court-finds-texas-prenup-did-not-waive-reimbursement-claims-costing-wife-over-200000-in-divorce\/","title":{"rendered":"Court Finds Texas Prenup Did Not Waive Reimbursement Claims Costing Wife over $200,000 in Divorce"},"content":{"rendered":"<p>Texas spouses may agree in writing to partition or exchange some or all of their community property between themselves such that the property becomes the separate property of one spouse. \u00a0A former wife recently <a href=\"https:\/\/www.mcclure-lawgroup.com\/marital-agreements.html\" target=\"_blank\" rel=\"noopener\">challenged<\/a> her divorce decree, arguing the trial court erred in awarding a reimbursement claim against her, reducing the spousal maintenance below the amount stated in the parties\u2019 agreement, and including contingencies on the spousal maintenance that were not in the agreement.<\/p>\n<p>According to the appeals court\u2019s opinion, the parties married in 2006. They signed a Marital Property Partition and Exchange Agreement in 2020 that made two pieces of property the wife\u2019s sole and separate property.\u00a0 She agreed to be responsible for the debt associated with them.\u00a0 The husband, however, made some of those payments from his community property income until the date of divorce.<\/p>\n<p>The couple stopped living together in 2022 and the husband petitioned for divorce.
