A spouse\u2019s separate property includes the property they received during the marriage through gift, descent, or devise. Tex. Fam. Code \u00a7 3.001.\u00a0 In a recent <a href=\"https:\/\/cases.justia.com\/texas\/third-court-of-appeals\/2025-03-23-00407-cv.pdf?ts=1753881891\" target=\"_blank\" rel=\"noopener\">case<\/a>, a former husband challenged his divorce decree that characterized mineral rights he obtained from his mother\u2019s trust as community property.<\/p>\n<p>According to the opinion, when the husband\u2019s mother died, she left a trust for the benefit of the husband\u2019s father during his lifetime.\u00a0 The trust included mineral rights to certain property, which the husband\u2019s father transferred to the husband and his siblings on November 1, 2009.\u00a0 The deed stated the grantor transferred the mineral rights to the husband and his five siblings \u201c[f]or an adequate consideration paid and received.\u201d<\/p>\n<p>The husband testified his father gifted each sibling $12,000 from their mother\u2019s estate to purchase the mineral rights.\u00a0 He presented a carbon copy check for $12,000 dated November 19, 2009, but it did not have an account number, payor name, or signature.
