A Texas appeals court recently decided a second appeal in a case involving a mediated settlement agreement (\u201cMSA\u201d) with potentially conflicting provisions related to the parties\u2019 taxes.<\/p>\n<p>According to the appeals court\u2019s <a href=\"https:\/\/cases.justia.com\/texas\/second-court-of-appeals\/2025-02-24-00261-cv.pdf?ts=1752248999\" target=\"_blank\" rel=\"noopener\">opinion<\/a>, the parties\u2019 MSA was divided into two parts.\u00a0 Part I was what the parties referred to as the \u201cboilerplate\u201d section and Part II included specific provisions addressing the children and the property division.<\/p>\n<p>Federal tax liabilities were addressed in two provisions, one in each part.
