Fam. Code \u00a7 6.001 allows a court to \u201cgrant divorce without regard to fault\u201d if it finds the marriage has become insupportable without \u201cany reasonable expectation of reconciliation. \u00a0A court may also grant a divorce in favor of one spouse if it finds cruel treatment or adultery by the other spouse. Tex. Fam. Code \u00a7\u00a7 6.002 &#8211; 6.003. In a <a href=\"https:\/\/cases.justia.com\/texas\/thirteenth-court-of-appeals\/2025-13-23-00446-cv.pdf?ts=1747314597\" target=\"_blank\" rel=\"noopener\">recent case<\/a>, a former wife appealed the divorce decree granting divorce based on insupportability when she argued she had presented sufficient evidence of her husband\u2019s cruel treatment of her.\u00a0 She also challenged the court\u2019s denial of her request for spousal maintenance.<\/p>\n<p>According to the appeals court\u2019s opinion, the parties got married in March 2019 and separated about a year later.\u00a0 The wife accused the husband of choking her and he was arrested.\u00a0 An emergency order of protection prohibited him from going within 200 yards of the parties\u2019 home. \u00a0A district court ultimately entered a final protective order and found the husband had \u201ccommitted family violence.\u201d Due to that order, the wife had exclusive use of the home and the husband was ordered to pay the expenses for the home in addition to paying the wife monthly support.<\/p>\n<p>The wife petitioned for divorce.\u00a0 She asserted insupportability and cruelty as alternative grounds for the divorce.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/court-determines-wifes-spousal-maintenance-should-be-considered\/#more-3014\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Tex.
