The date of marriage affects the characterization of property and therefore a dispute over the date of marriage can significantly impact the property division. A former husband recently <a href=\"https:\/\/cases.justia.com\/texas\/first-court-of-appeals\/2025-01-23-00374-cv.pdf?ts=1742917742\" target=\"_blank\" rel=\"noopener\">appealed<\/a> a divorce decree, arguing in part that the trial court erred in finding the parties were married on or about January 1, 2012, which was before their ceremonial wedding.<\/p>\n<p>According to the appeals court, the parties had a ceremonial wedding in January 2013.\u00a0 The husband petitioned for divorce in late 2020, alleging they had \u201cmarried on or about January 31, 2013.\u201d In the wife\u2019s counterpetition, she alleged they \u201cmarried on or about January 1, 2012.\u201d<\/p>\n<p>The trial focused on the marital residence, some property in Mexico, and the husband\u2019s trucking company.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-finds-insufficient-evidence-of-informal-marriage\/#more-2991\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Generally, the date of a marriage is certain, but that is often not the case with an informal marriage.
