The Texas Family Code sets out guidelines for the duration of a spousal support order, but the obligation to pay future maintenance also terminates on the death of either party, remarriage of the former spouse receiving maintenance, or upon a finding the former spouse receiving maintenance is cohabiting with a romantic partner. Tex. Fam. Code \u00a7 8.056.<\/p>\n<p>In a <a href=\"https:\/\/cases.justia.com\/texas\/fourth-court-of-appeals\/2024-04-23-00873-cv.pdf?ts=1733321073\" target=\"_blank\" rel=\"noopener\">recent case<\/a>, a Texas appeals court considered whether a former husband\u2019s obligation to pay property taxes should have been terminated with the monthly spousal maintenance when the former wife was cohabiting with a romantic partner.<\/p>\n<p><strong>Divorce Decree<\/strong><\/p>\n<p>The 2014 final divorce decree awarded the former husband as separate property \u201call rights, title, and interest\u201d in a particular piece of real estate in San Antonio.\u00a0 It also awarded the former wife a life estate in that property.\u00a0 The husband was ordered to pay $1,500 in monthly spousal support, as well as the mortgage payments as \u201can additional spousal support obligation.\u201d<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-requires-ex-husband-to-continue-paying-taxes-on-property-where-ex-wife-lives\/#more-2945\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Texas spousal maintenance is only awarded under certain specific circumstances.
