{"id":2937,"date":"2024-11-13T20:15:52","date_gmt":"2024-11-14T02:15:52","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=2937"},"modified":"2024-11-26T08:10:36","modified_gmt":"2024-11-26T14:10:36","slug":"determining-law-governing-pre-marital-agreement-in-high-net-worth-divorce","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/determining-law-governing-pre-marital-agreement-in-high-net-worth-divorce\/","title":{"rendered":"Determining Law Governing Pre-Marital Agreement in High Net Worth Divorce"},"content":{"rendered":"<p>A pre-marital agreement can be a valuable way to protect assets in a high net worth Texas divorce.\u00a0 A pre-marital agreement can help protect a spouse\u2019s interest in a business, identify property that will remain separate, or describe how a complex estate will be divided in the event of a divorce.\u00a0 In some cases, however, a party may challenge the validity of the pre-marital agreement.\u00a0 The Texas Family Code sets forth the circumstances under which a pre-marital agreement will not be enforced, but matters may become more complicated if the agreement was signed in another state.\u00a0 A wife recently <a href=\"https:\/\/cases.justia.com\/texas\/thirteenth-court-of-appeals\/2024-13-22-00449-cv.pdf?ts=1713443308\" target=\"_blank\" rel=\"noopener\">challenged<\/a> an order applying Louisiana law to the validity and enforceability of a pre-marital agreement.<\/p>\n<p><strong>The Pre-marital Agreement<\/strong><\/p>\n<p>The parties got married in Louisiana in 1990.\u00a0 They purportedly signed a pre-marital agreement pursuant to Louisiana law a few days before the marriage.\u00a0 The agreement provided that only the husband\u2019s salary from a particular company would be community property. All other income generated by his efforts would remain his separate property.\u00a0 All revenue generated by the wife\u2019s efforts would be her separate property.<\/p>\n<p><strong>Applicable Law<\/strong><\/p>\n<p>The wife petitioned for divorce in Texas in 2019.\u00a0 The husband asked the trial court to enforce the agreement.
