{"id":2890,"date":"2024-09-21T09:30:51","date_gmt":"2024-09-21T14:30:51","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=2890"},"modified":"2024-11-08T10:31:27","modified_gmt":"2024-11-08T16:31:27","slug":"texas-child-support-guidelines-applied-to-earning-potential","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-child-support-guidelines-applied-to-earning-potential\/","title":{"rendered":"Voluntary Underemployment in Dallas Custody Dispute"},"content":{"rendered":"<p>Parents are obligated to support their minor children and cannot avoid their obligation through voluntary unemployment or underemployment.\u00a0 If a parent\u2019s actual income is significantly less than what they could earn due to intentional unemployment or underemployment, the court may apply the Texas support guidelines to their earning potential.\u00a0 Once the obligor has provided proof of his current wages, the obligee has the burden of showing intentional unemployment or underemployment.\u00a0 If they do so, the burden then shifts back to the obligor for rebuttal.\u00a0 A father recently <a href=\"https:\/\/cases.justia.com\/texas\/third-court-of-appeals\/2024-03-22-00631-cv.pdf?ts=1717763318\" target=\"_blank\" rel=\"noopener\">challenged<\/a> a court\u2019s findings that he was underemployed and that it was in the child\u2019s best interest to apply the child support guidelines to his earning potential.<\/p>\n<p>The father registered a New York child support order in Texas and moved to modify the parent-child relationship.\u00a0 The order required the father to pay child support of $1,437.44 and medical support of $107.03 each month.\u00a0 He requested a reduction to $377, retroactive to the date he petitioned to reduce his arrearages.<\/p>\n<p>The mother filed a motion to enforce, seeking contempt against the father for failure to pay the support and the arrearages.
