{"id":2888,"date":"2024-09-13T18:59:27","date_gmt":"2024-09-13T23:59:27","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=2888"},"modified":"2024-11-08T10:33:30","modified_gmt":"2024-11-08T16:33:30","slug":"judicial-admissions-in-texas-custody-modification-case","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/judicial-admissions-in-texas-custody-modification-case\/","title":{"rendered":"Judicial Admissions in Texas Custody Modification Case"},"content":{"rendered":"<p>Generally, to obtain modification of a Texas custody or child support order, a parent must show that there has been a material and substantial change in circumstances since the prior order.\u00a0 Texas courts have held that a parent alleging a material and substantial change of circumstances in their counter-petition has judicially admitted the existence of a material and substantial change in circumstances.\u00a0 In a recent case, a mother <a href=\"https:\/\/cases.justia.com\/texas\/seventh-court-of-appeals\/2024-07-24-00020-cv.pdf?ts=1722418052\" target=\"_blank\" rel=\"noopener\">appealed<\/a> an order granting the father\u2019s counterpetition request for modification after granting summary judgment against her modification petition.<\/p>\n<p><strong>Proceedings<\/strong><\/p>\n<p>The parties got divorced in 2017 and entered into a mediated settlement agreement (\u201cMSA\u201d).\u00a0 The MSA named the parties joint managing conservators of their child and placed a geographic restriction of Lubbock County on the child\u2019s residence.\u00a0 It stated that if either party moved out of the county, the parent who remained would get the exclusive right to designate the child\u2019s residence in Lubbock County.<\/p>\n<p>The mother got married again and moved to Indiana in September 2020.\u00a0 The father stayed in Lubbock County.
