{"id":2872,"date":"2024-07-28T18:21:43","date_gmt":"2024-07-28T23:21:43","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=2872"},"modified":"2024-08-07T09:54:34","modified_gmt":"2024-08-07T14:54:34","slug":"failure-to-pay-debt-ordered-in-texas-divorce-is-not-enforceable-by-contempt","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/failure-to-pay-debt-ordered-in-texas-divorce-is-not-enforceable-by-contempt\/","title":{"rendered":"Failure to Pay Debt Ordered in Texas Divorce Is Not Enforceable by Contempt"},"content":{"rendered":"<p>Courts are required to effect a just and right division of the community estate in a Texas divorce.\u00a0 This division is not limited to assets, but in many cases, the court must also apportion the parties\u2019 debts.\u00a0 A former husband recently <a href=\"https:\/\/cases.justia.com\/texas\/first-court-of-appeals\/2024-01-23-00244-cv.pdf?ts=1721737943\" target=\"_blank\" rel=\"noopener\">challenged<\/a> a provision in his divorce decree making his failure to make loan payments enforceable by contempt.<\/p>\n<p>The husband asked the court to divide the estate in a manner it deemed just and right.\u00a0 The wife indicated she believed they would enter into an agreement for the property division, and, if so, the court to approve the agreement and divide the estate accordingly.\u00a0 Alternatively, she requested a just and right division.<\/p>\n<p>The parties were not able to reach an agreement.\u00a0 They had a trial before the associate court.\u00a0 The husband asked the trial court for a de novo trial.\u00a0 Following the new trial, the trial court notified the parties it agreed with the property division by the associate trial court.
