{"id":2864,"date":"2024-06-30T12:05:05","date_gmt":"2024-06-30T17:05:05","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=2864"},"modified":"2024-07-02T08:24:49","modified_gmt":"2024-07-02T13:24:49","slug":"texas-appeals-court-concludes-child-can-only-have-one-home-state-in-child-support-case","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-concludes-child-can-only-have-one-home-state-in-child-support-case\/","title":{"rendered":"Texas Appeals Court Concludes Child Can Only Have One Home State in Child Support Case"},"content":{"rendered":"<p>The Uniform Child Custody Jurisdiction and Enforcement Act (\u201cUCCJEA\u201d) governs which state\u2019s courts have jurisdiction over an initial custody determination.\u00a0 Texas has codified the UCCJEA in Chapter 152 of the Texas Family Code.\u00a0 A Texas court has jurisdiction if Texas is the child\u2019s \u201chome state\u201d when the proceeding commences or was the child\u2019s home state within the six months before the proceeding commences and a parent still lives in Texas.\u00a0 Tex. Fam. Code \u00a7 152.201(a)(1).\u00a0 \u201cHome state\u201d is defined as the state where the child lived with a parent or person acting as such for the six months immediately before the custody proceeding commenced.\u00a0 If the child is less than six months old, the home state is where \u201cthe child lived from birth with a parent or a person acting as a parent.\u201d\u00a0 Tex. Fam.
