Fam. Code \u00a7 153.134(b)(1).\u00a0 The court bases its determination on the specific facts of the case.\u00a0 The trial court also has discretion to impose restrictions on a parent\u2019s possession and access to the child that are in the child\u2019s best interest.\u00a0 A father recently <a href=\"https:\/\/cases.justia.com\/texas\/third-court-of-appeals\/2024-03-23-00399-cv.pdf?ts=1719491334\" target=\"_blank\" rel=\"noopener\">challenged<\/a> a number of issues related to his possession and access to his children.<\/p>\n<p>According to the opinion of the appeals court, the parties married in 2017 and had two children together.\u00a0 The mother petitioned for divorce in 2020, requesting the father have supervised possession of the children, submit to random alcohol and drug testing, and use a Soberlink monitoring device.\u00a0 A number of witnesses testified, including a custody evaluation expert and a co-parenting therapist, both of whom the court found credible.\u00a0 The final divorce decree named the parties joint managing conservators but gave the mother the exclusive right to designate the children\u2019s primary residence with a geographic restriction of Williamson and contiguous counties.\u00a0 The order provided for a step-up possession schedule for the father and limited both parents\u2019 romantic partners being around the children.<\/p>\n<p><strong>Geographic Restriction<\/strong><\/p>\n<p>The father appealed, challenging the geographic restriction. He argued it should be limited to Williamson County without including contiguous counties.
