{"id":2858,"date":"2024-06-14T17:06:02","date_gmt":"2024-06-14T22:06:02","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=2858"},"modified":"2024-07-02T08:24:19","modified_gmt":"2024-07-02T13:24:19","slug":"texas-appeals-court-affirms-modification-naming-father-sole-managing-conservator","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-affirms-modification-naming-father-sole-managing-conservator\/","title":{"rendered":"Texas Appeals Court Affirms Modification Naming Father Sole Managing Conservator"},"content":{"rendered":"<p>To modify a Texas custody order, the court must find that there has been a material and substantial change in circumstances and that the modification would be in the children\u2019s best interest.\u00a0 In a recent case, a mother <a href=\"https:\/\/cases.justia.com\/texas\/seventh-court-of-appeals\/2024-07-24-00002-cv.pdf?ts=1714555592\" target=\"_blank\" rel=\"noopener\">challenged<\/a> the court\u2019s finding that it was in the children\u2019s best interest for the father to be the sole managing conservator following involvement by the Department of Family and Protective Services.<\/p>\n<p><strong>History<\/strong><\/p>\n<p>When the parents divorced, they were named joint managing conservators and the mother was awarded the right to designate the children\u2019s primary residence.<\/p>\n<p>The mother testified that the father did not regularly visit the children or telephone them.\u00a0 She said she \u201cmoved a lot\u201d with the children and did not communicate with them.\u00a0 She was homeless for a week or two.
