{"id":2838,"date":"2024-04-19T09:24:47","date_gmt":"2024-04-19T14:24:47","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=2838"},"modified":"2024-04-19T09:24:47","modified_gmt":"2024-04-19T14:24:47","slug":"how-substance-abuse-affects-parental-rights-and-custody-in-texas","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/how-substance-abuse-affects-parental-rights-and-custody-in-texas\/","title":{"rendered":"How Substance Abuse Affects Parental Rights and Custody in Texas"},"content":{"rendered":"<p>Substance abuse can be devastating to families.\u00a0 Texas family law recognizes the risk to children from parental substance abuse and seeks to protect them.<\/p>\n<p><strong>Termination of Parental Rights<\/strong><\/p>\n<p>One of the most severe potential consequences of substance abuse is termination of parental rights.\u00a0 The court may terminate the parental rights of a parent who is the cause of a child being born addicted to alcohol or an illegal controlled substance.\u00a0 Additionally, a court may order termination of parental rights if it finds by clear and convincing evidence that the parent used a controlled substance in a way that endangered the child\u2019s health or safety and either failed to complete a court-ordered treatment program or continued to abuse a controlled substance after completing a court-ordered program. <a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/FA\/htm\/FA.161.htm\" target=\"_blank\" rel=\"noopener\">Tex.
