{"id":2832,"date":"2024-04-07T14:40:17","date_gmt":"2024-04-07T19:40:17","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=2832"},"modified":"2024-04-16T08:13:44","modified_gmt":"2024-04-16T13:13:44","slug":"texas-appeals-court-reverses-restitution-and-reconstitution-of-community-estate","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-reverses-restitution-and-reconstitution-of-community-estate\/","title":{"rendered":"Texas Appeals Court Reverses Restitution and Reconstitution of Community Estate"},"content":{"rendered":"<p>A party to a Texas divorce is entitled to reimbursement to the marital estate when community time, labor, or skills are used to benefit the other party\u2019s separate estate beyond what is needed for maintenance of the separate property.\u00a0 The trial court has broad discretion to apply equitable principles.\u00a0 A former wife recently <a href=\"https:\/\/cases.justia.com\/texas\/thirteenth-court-of-appeals\/2024-13-23-00343-cv.pdf?ts=1711630217\" target=\"_blank\" rel=\"noopener\">challenged<\/a> a divorce decree that granted her former husband\u2019s requests for reimbursement and reconstitution of the community estate.<\/p>\n<p>According to the appeals court\u2019s opinion, the husband requested a disproportionate share of the community property and reimbursement to both the community estate and his separate estate.\u00a0 He argued the wife\u2019s separate estate had benefited from both the community and his separate estate.\u00a0 He also alleged the wife conspired with her daughter \u201cto accomplish an unlawful purpose and\/or to accomplish a lawful purpose by unlawful means\u201d to dispose of the proceeds from the sale of a house. He sought actual and exemplary damages as well as attorney\u2019s fees.<\/p>\n<p>The wife also requested a disproportionate share of the community estate.
