{"id":2830,"date":"2024-03-31T18:17:12","date_gmt":"2024-03-31T23:17:12","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=2830"},"modified":"2024-04-16T08:13:33","modified_gmt":"2024-04-16T13:13:33","slug":"division-of-military-retirement-in-a-texas-divorce","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/division-of-military-retirement-in-a-texas-divorce\/","title":{"rendered":"Division of Military Retirement in a Texas Divorce"},"content":{"rendered":"<p>A Domestic Relations (\u201cDRO\u201d) is often used in divorce to address the rights of the former spouse as an alternate payee to receive some or all of a participant\u2019s benefits under a retirement plan.\u00a0 A trial court generally does not have the authority to render orders after expiration of its plenary power over a final judgment.\u00a0 If a Texas divorce decree becomes final and unappealable without rendering a DRO, then the trial court only has the authority to render a valid DRO upon a petition and service pursuant to the Texas Rules of Civil Procedure.\u00a0 A judgment is rendered when the trial court officially announces its decision orally in open court or in a filed memorandum. An oral rendition must indicate the trail court\u2019s intent to render the full, final, and complete judgment.<\/p>\n<p>A husband recently <a href=\"https:\/\/cases.justia.com\/texas\/fourth-court-of-appeals\/2024-04-22-00677-cv.pdf?ts=1711543640\" target=\"_blank\" rel=\"noopener\">appealed<\/a> a DRO.\u00a0 The parties entered into a mediated settlement (\u201cMSA\u201d) that was memorialized in the agreed final divorce decree.\u00a0 The decree included provisions related to the husband\u2019s military retirement and stated they would be more particularly described in a Domestic Relations Order (\u201cDRO\u201d).\u00a0 The husband his attorney signed the decree.\u00a0 The husband moved for the signing of the DRO in June 2022, stating he believed the proposed DRO accurately reflected the parties\u2019 agreements.\u00a0 The court and the parties\u2019 attorneys signed the DRO.<\/p>\n<p>After the husband got a new attorney, he moved to vacate the DRO, arguing the divorce decree was not a rendition of judgment on the DRO and the DRO had been rendered outside the court\u2019s plenary power.\u00a0 He argued, in the alternative, for modification of the DRO because the calculation used to determine the wife\u2019s share was not in compliance with federal law.\u00a0 The trial court denied the motion.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/division-of-military-retirement-in-a-texas-divorce\/#more-2830\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Domestic Relations (\u201cDRO\u201d) is often used in divorce to address the rights of the former spouse as an alternate payee to receive some or all of a participant\u2019s benefits under a retirement plan.\u00a0 A trial court generally does not have the authority to render orders after expiration of its plenary power over a final [&hellip;]<\/p>\n","protected":false},"author":11,"featured_media":0,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[4,56],"tags":[],"class_list":["post-2830","post","type-post","status-publish","format-standard","hentry","category-divorce","category-military"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Division of Military Retirement in a Texas Divorce &#8212;
