{"id":2828,"date":"2024-03-27T19:50:19","date_gmt":"2024-03-28T00:50:19","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=2828"},"modified":"2024-03-28T11:14:14","modified_gmt":"2024-03-28T16:14:14","slug":"enforcement-of-unpaid-obligations-in-texas-divorce-decree","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/enforcement-of-unpaid-obligations-in-texas-divorce-decree\/","title":{"rendered":"Enforcement of Unpaid Obligations in Texas Divorce Decree"},"content":{"rendered":"<p>If a parent does not comply with a Texas custody or child support order, the other parent may seek enforcement of the court order and, in some cases, request the parent be held in contempt.\u00a0 A father recently <a href=\"https:\/\/cases.justia.com\/texas\/fourth-court-of-appeals\/2024-04-22-00415-cv.pdf?ts=1710961190\" target=\"_blank\" rel=\"noopener\">challenged<\/a> an order granting the mother\u2019s motion to enforce the divorce decree.<\/p>\n<p>When the parties divorced, one of their two children was still a minor.\u00a0 Pursuant to the divorce decree, \u00a0the parties were required to equally share health care costs, the cost of a vehicle, and college fund for the minor child.\u00a0 The decree also ordered the father to pay for the minor child\u2019s phone plan until she finished high school, and then that expense would also be split.\u00a0 The decree incorporated an agreement incident to divorce that required the mother and father to share the other child\u2019s healthcare costs.<\/p>\n<p>Both parties moved to enforce the decree in 2019, each seeking contempt, or clarification if the court found the decree was not sufficiently specific.\u00a0 The trial court\u2019s subsequent order required the parties to communicate and exchange expense sharing exclusively through MyFamilyWizard.\u00a0 The court\u2019s order also clarified that the father was required to pay full cost of the minor child\u2019s phone.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/enforcement-of-unpaid-obligations-in-texas-divorce-decree\/#more-2828\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>If a parent does not comply with a Texas custody or child support order, the other parent may seek enforcement of the court order and, in some cases, request the parent be held in contempt.\u00a0 A father recently challenged an order granting the mother\u2019s motion to enforce the divorce decree.
