Fam. Code \u00a7 153.432, a grandparent who meets certain requirements has standing to file suit for possession or access to their grandchild.\u00a0 The grandparent must sign an affidavit \u201con knowledge or belief\u201d that alleges that denial of possession or access would significantly impair the physical health or emotional well-being of the child and provides supporting facts.\u00a0 The trial court then has to determine if those allegations would be sufficient to grant possession or access under Section 153.433. If not, the trial court must dismiss the grandparent\u2019s suit.<\/p>\n<p>Parents have a fundamental right to make decisions about their children\u2019s care, custody, and control.\u00a0 The law presumes that a fit parent acts in their children\u2019s best interest.\u00a0 Once the grandparent establishes standing, they must overcome the fit-parent presumption by proving denying them possession or access would significantly impair the child\u2019s health or well-being. \u00a0The grandparent must allege \u201cspecific, identifiable behavior or conduct,\u201d such as severe neglect, physical abuse, abandonment, abuse of drugs or alcohol, or immoral behavior, that would likely cause significant impairment to the child.\u00a0 <em>Rolle v. Hardy<\/em>.\u00a0 Prior cases have held that illegal drug use by a mother during pregnancy may support a finding of significant impairment and illegal drug use after the birth may impair the ability to parent.\u00a0 A grandparent does not have standing just because the child wants to see them or because they would be a better custodian. A grandmother recently <a href=\"https:\/\/d.docs.live.net\/5de6e4e09fd06d72\/Documents\/McClure\/In%20re%20ISP\/The%20child.docx\" target=\"_blank\" rel=\"noopener\">challenged<\/a> a court order dismissing her petition for possession or access to her grandchild.<\/p>\n<p><strong>The Grandmother\u2019s Petition<\/strong><\/p>\n<p>The child\u2019s father died before the child was born.\u00a0 His mother then petitioned for grandparent possession of or access to the child shortly after the birth.\u00a0 The grandmother alleged the mother had abused drugs and alcohol while she was pregnant with the child.\u00a0 She claimed denying her access to the child would significantly impair his health and well-being.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-reverses-dismissal-of-grandmothers-petition-for-visitation\/#more-2826\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Pursuant to Tex.
