{"id":2818,"date":"2024-02-28T20:35:07","date_gmt":"2024-02-29T02:35:07","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=2818"},"modified":"2024-03-28T11:13:07","modified_gmt":"2024-03-28T16:13:07","slug":"texas-appeals-court-concluded-father-did-not-have-sufficient-notice-for-contempt-order","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-concluded-father-did-not-have-sufficient-notice-for-contempt-order\/","title":{"rendered":"Texas Appeals Court Concluded Father Did Not Have Sufficient Notice for Contempt Order"},"content":{"rendered":"<p>Parents sometimes have difficulty getting their child\u2019s other parent to comply with a Texas custody or visitation order. \u00a0If a parent fails to comply with requirements to exchange the child, the other parent may seek enforcement of the court\u2019s order, sometimes through contempt.\u00a0 In a recent case, a father challenged a court\u2019s contempt order.<\/p>\n<p>According to the appeals court\u2019s <a href=\"https:\/\/cases.justia.com\/texas\/second-court-of-appeals\/2024-02-24-00018-cv.pdf?ts=1709095483\" target=\"_blank\" rel=\"noopener\">opinion<\/a>, the trial court entered a standard possession order in 2012 that set forth where the exchanges were to occur.\u00a0 When the mother\u2019s possession ended, the exchange occurred at her home.\u00a0 When the father\u2019s possession ended, it occurred at either his home or the mother\u2019s home, depending upon circumstances set forth in the order.\u00a0 The trial court signed a modification order on the mother\u2019s motion in March 2017 that changed the exchange location to the police department parking lot.\u00a0 The modification order also allowed the parties to change the location in writing.\u00a0 In August 2017, the parties entered a Rule 11 agreement moving the exchange location to a different police department parking lot and the court signed and the court signed an order adopting their agreement.<\/p>\n<p>The mother filed a motion for enforcement by contempt in 2023.\u00a0 She relied on the original 2012 order and the 2017 modification order.
