{"id":2778,"date":"2023-11-29T19:22:40","date_gmt":"2023-11-30T01:22:40","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=2778"},"modified":"2023-12-07T13:12:02","modified_gmt":"2023-12-07T19:12:02","slug":"texas-appeals-court-affirms-disproportionate-property-division","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-affirms-disproportionate-property-division\/","title":{"rendered":"Texas Appeals Court Affirms Disproportionate Property Division"},"content":{"rendered":"<p>The court in a Texas divorce must make a just and right division of the marital estate.\u00a0 The estate does not have to be equally divided if there is a reasonable basis in the record for an unequal division.\u00a0 A former husband recently <a href=\"https:\/\/cases.justia.com\/texas\/third-court-of-appeals\/2023-03-22-00178-cv-0.pdf?ts=1701177807\" target=\"_blank\" rel=\"noopener\">challenged<\/a>, for the second time, the property division in his divorce.<\/p>\n<p><strong>The First Appeal<\/strong><\/p>\n<p>In his first appeal, the husband argued the trial court erred in its property division by including the value of a condominium that he claimed belonged to his father.\u00a0 The appeals court concluded the condominium belonged to the husband, wife, and the husband\u2019s father and that the trial court had erred in including its total value in the community estate.\u00a0 The appeals court determined including only the two spouses\u2019 interest in the valuation of the community estate would materially affect the property division, it remanded to the trial court for a just and right division.<\/p>\n<p>The trial court signed an order on remand that stated its original community property division was just and right.\u00a0 Furthermore, the trial court awarded the wife appellate attorney\u2019s fees.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-affirms-disproportionate-property-division\/#more-2778\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The court in a Texas divorce must make a just and right division of the marital estate.\u00a0 The estate does not have to be equally divided if there is a reasonable basis in the record for an unequal division.\u00a0 A former husband recently challenged, for the second time, the property division in his divorce.
