Fam. Code \u00a7 2.401. A man recently <a href=\"https:\/\/cases.justia.com\/texas\/second-court-of-appeals\/2023-02-23-00209-cv.pdf?ts=1699622891\" target=\"_blank\" rel=\"noopener\">appealed<\/a> summary judgment in his divorce case on the ground he had not raised an issue of fact as to the existence of an informal marriage.<\/p>\n<p><strong>Divorce Case<\/strong><\/p>\n<p>The petitioner filed for divorce in November 2021, alleging the parties had been married on or about March 18, 2002.<\/p>\n<p>In her answer, the respondent asserted a verified defense that they parties were not married.
