{"id":2761,"date":"2023-10-13T23:41:23","date_gmt":"2023-10-14T04:41:23","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=2761"},"modified":"2023-11-20T06:57:19","modified_gmt":"2023-11-20T12:57:19","slug":"texas-enforcement-order-reversed-due-to-due-process-issues-at-hearing","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-enforcement-order-reversed-due-to-due-process-issues-at-hearing\/","title":{"rendered":"Texas Enforcement Order Reversed Due to Due Process Issues at Hearing"},"content":{"rendered":"<p>A trial court in a Texas divorce case has discretion in how the trial is conducted, but that discretion is not unlimited.\u00a0 In a recent case, the appeals court determined the trial court abused its discretion by imposing time restrictions that allowed the husband more time to present the case than it allowed the wife and by refusing the wife\u2019s request to present an offer of proof.<\/p>\n<p>According to the appeals <a href=\"https:\/\/cases.justia.com\/texas\/second-court-of-appeals\/2023-02-22-00092-cv.pdf?ts=1696562419\" target=\"_blank\" rel=\"noopener\">court\u2019s opinion<\/a>, the divorce decree awarded the wife the marital residence; the entire community interest in a business; three of the business\u2019s bank accounts, with the husband receiving half of the funds in them; and the household furniture and other personal property in her possession or control.\u00a0 The husband was awarded 50% of the equity in the house;
