Fam. Code \u00a7 153.002.\u00a0 There is a rebuttable presumption that the parents being named joint managing conservators is in the child\u2019s best interest.\u00a0 Tex. Fam. Code \u00a7 153.131.\u00a0 When a court names parents joint managing conservators, it must also designate which of them has the exclusive right to determine the child\u2019s primary residence. \u00a0Custody matters are highly fact-based, and the court generally has broad discretion in determining the child\u2019s best interest and deciding who will have the exclusive right to determine the child\u2019s primary residence.\u00a0 A father recently challenged the custody, child support, and property division in his divorce.<\/p>\n<p><strong>Custody<\/strong><\/p>\n<p>The parties separated after fourteen years of marriage.\u00a0 They had two children together.\u00a0 The trial court named both parents joint managing conservators with the mother having the exclusive rights to designate the children\u2019s primary residence, receive child support, and make educational decisions.<\/p>\n<p>According to the <a href=\"https:\/\/cases.justia.com\/texas\/tenth-court-of-appeals\/2023-10-21-00299-cv.pdf?ts=1679564354\" target=\"_blank\" rel=\"noopener\">appeals court<\/a>, the record showed that one of the children said she would \u201crather stay with mom.\u201d \u00a0\u00a0The mother testified she had been the parent who took care of the children when they were sick, took them to medical appointments, prepared food, helped with homework, and put them to bed.\u00a0 She testified she thought it was in the children\u2019s best interest to live with her.\u00a0 She alleged the father drank too much around the children.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/court-has-broad-discretion-in-determining-texas-custody\/#more-2757\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The court\u2019s primary consideration in determining Texas custody is the best interest of the child.\u00a0 Tex.
