{"id":2707,"date":"2023-06-21T11:04:45","date_gmt":"2023-06-21T16:04:45","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=2707"},"modified":"2023-07-27T10:32:16","modified_gmt":"2023-07-27T15:32:16","slug":"legal-description-of-property-controls-over-address-in-texas-husbands-quitclaim-deed-to-wife","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/legal-description-of-property-controls-over-address-in-texas-husbands-quitclaim-deed-to-wife\/","title":{"rendered":"Legal Description of Property Controls Over Address in Texas Husband&#8217;s Quitclaim Deed to Wife"},"content":{"rendered":"<p>When one spouse transfers property to the other spouse by deed, there is a rebuttable presumption the property was gifted to the other spouse as separate property.\u00a0 A deed must contain a sufficient description of the property.\u00a0 In some cases, there may be mistakes or conflicting information in the deed.\u00a0 When a court interprets a deed, it must determine the parties\u2019 intent as expressed in the deed.\u00a0 A wife recently <a href=\"https:\/\/cases.justia.com\/texas\/second-court-of-appeals\/2023-02-22-00471-cv.pdf?ts=1686886982\" target=\"_blank\" rel=\"noopener\">challenged<\/a> a court\u2019s interpretation of a quitclaim deed and the resulting characterization of the property based on a deed that stated the address for one tract of land but the legal description of another.<\/p>\n<p>The husband bought a house and 23 acres and paid off the mortgage before the marriage.\u00a0 He also sold two of those acres and a mobile home before the marriage.
