Fam. Code Ann. \u00a7 3.003(a).\u00a0 Property\u2019s characterization is determined by inception of its title.\u00a0 In a <a href=\"https:\/\/cases.justia.com\/texas\/sixth-court-of-appeals\/2023-06-22-00077-cv.pdf?ts=1684932111\" target=\"_blank\" rel=\"noopener\">recent case<\/a>, a husband challenged a trial court\u2019s characterization of property conveyed by his parents.<\/p>\n<p><strong>Conveyance of the Property<\/strong><\/p>\n<p>According to the appeals court\u2019s opinion, the husband acquired the property from his parents during the marriage.\u00a0 The deed was labeled a warranty deed.\u00a0 It identified the parents as the grantors and the husband, \u201cA MARRIED PERSON,\u201d as the grantee.\u00a0 It stated consideration of $10 and \u201cother good and valuable consideration.\u201d\u00a0 It also stated the grantor \u201cgrants, sells, and conveys to Grantee the property.\u201d\u00a0 A corrected deed was filed in 2015 changing the legal description.<\/p>\n<p>The wife testified the husband\u2019s parents were paid $1,750 for the property from a joint bank account.\u00a0 The husband and his father each testified that just $10 was paid as consideration for the property.\u00a0 Both spouses were listed on the construction loan application for building the home on the property.\u00a0 That application indicated the title would be held \u201cJointly with Spouse.\u201d<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-characterizes-property-conveyed-by-husbands-parents-as-community-property\/#more-2698\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a Texas divorce, there is a presumption that property possessed by either party during or on dissolution is community property.\u00a0 Tex.
