They may resolve part or all of their disputes through mediation.\u00a0 A mediated settlement agreement (\u201cMSA\u201d) is binging on both parties if it prominently states that it is not subject to revocation, is signed by both parties, and is signed by the party\u2019s attorney, if present.\u00a0 Tex. Fam. Code Ann. \u00a7 6.602.\u00a0 In some cases, an MSA may include an arbitration provision, requiring the parties to arbitrate disputes arising from the MSA.\u00a0 A wife recently <a href=\"https:\/\/cases.justia.com\/texas\/fourteenth-court-of-appeals\/2023-14-21-00696-cv.pdf?ts=1678873460\" target=\"_blank\" rel=\"noopener\">appealed<\/a> the divorce decree, arguing it did not comply with the parties\u2019 MSA and that the judgment based on the arbitrator\u2019s award should be overturned.<\/p>\n<p><strong>Mediation and Arbitration<\/strong><\/p>\n<p>The husband and wife entered into a mediated settlement agreement (\u201cMSA\u201d), agreeing to use a specific realtor to sell their properties. According to the appeals court\u2019s opinion, the husband obtained a new realter after the wife informed him the chosen realtor \u201cdeclined\u201d to sell their properties.\u00a0 That realtor found errors in the deed and recommended referred them to real estate attorneys.<\/p>\n<p>The parties did not agree on which realtor to use or if they should have the documents corrected by an attorney.\u00a0 Arbitration had been scheduled, with the arbitrator being the same person who had served as the parties\u2019 mediator.\u00a0 The wife obtained new counsel, who objected to the arbitrator due to concerns about impartiality.\u00a0 He also expressed an intention to move for a new trial or set aside the MSA. He alleged the husband\u2019s attorney failed to disclose a working relationship with the mediator before the mediation occurred.\u00a0 However, there were emails showing the husband\u2019s attorney had disclosed to the wife\u2019s previous attorney that she previously had been an intern with the mediator and the wife\u2019s attorney had no objection to the mediator.\u00a0 Additionally, she disclosed the same information to the wife\u2019s second counsel by phone, and the mediator stated before the mediation started that the husband\u2019s attorney had been an intern, and there were no objections.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-upholds-divorce-decree-following-arbitration-award\/#more-2678\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Parties to a Texas divorce may choose to pursue alternative dispute resolution to avoid litigation.
