There is a presumption that a fit parent acts in the child\u2019s best interest.\u00a0 A non-parent seeking visitation or custody over a parent\u2019s objection must overcome the fit-parent presumption. They must have evidence of behavior or conduct that will probably result in the child\u2019s health or well-being being significantly impaired.\u00a0 A non-parent seeking custody or visitation must also show that they meet the requirements for standing under Texas family law.<\/p>\n<h3>Grandmother Files Custody Suit<\/h3>\n<p>A mother recently challenged a court\u2019s judgment awarding visitation to the child\u2019s paternal grandmother.\u00a0 According to the appeals court\u2019s <a href=\"https:\/\/cases.justia.com\/texas\/thirteenth-court-of-appeals\/2022-13-22-00062-cv.pdf?ts=1661430036\" target=\"_blank\" rel=\"noopener\">opinion<\/a>, the paternal grandmother petitioned to be appointed as possessory conservator of the child, but subsequently amended the petition seeking possession and access.\u00a0 She alleged denial of possession and access would significantly impair the child\u2019s health and well-being.\u00a0 Her affidavit stated she was the parent of the child\u2019s father and the child\u2019s father had been incarcerated for more than three months.\u00a0 It further stated that the child lived in her home while the father temporarily had primary care of the child because of the \u201cmother\u2019s instability.\u201d She also stated the father was incarcerated because she had made a report \u201cto protect the child.\u201d<\/p>\n<p>The mother did not file an answer or appear at the remote trial.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-grandmother-lacked-standing-for-visitation\/#more-2485\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Parents have a fundamental right to make decisions about their child\u2019s care, custody, and control.
