A party claiming separate property must show that it is separate by clear and convincing evidence.\u00a0 A husband <a href=\"https:\/\/cases.justia.com\/texas\/fourteenth-court-of-appeals\/2022-14-21-00139-cv.pdf?ts=1660652442\" target=\"_blank\" rel=\"noopener\">recently challenged<\/a> a court\u2019s characterization of certain property as the wife\u2019s separate property.<\/p>\n<p>The parties got married in 1997 and the husband filed for divorce in 2019.\u00a0 Each party sought a disproportionate share of the marital estate.<\/p>\n<h3>Wife Asserts Separate-Property Claim<\/h3>\n<p>According to the appeals court\u2019s opinion, a significant issue in the divorce was property purchased by the wife in 1997 after the marriage.\u00a0 She leased the building in 1990 and renewed the lease in 1995.
