{"id":2445,"date":"2022-07-08T07:51:49","date_gmt":"2022-07-08T12:51:49","guid":{"rendered":"https:\/\/www.mcclure-lawgroup.com\/blog\/?p=2445"},"modified":"2022-07-04T22:00:26","modified_gmt":"2022-07-05T03:00:26","slug":"texas-appeals-court-holds-paternity-cannot-be-adjudicated-after-putative-fathers-death","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-holds-paternity-cannot-be-adjudicated-after-putative-fathers-death\/","title":{"rendered":"Texas Appeals Court Holds Paternity Cannot Be Adjudicated After Putative Father&#8217;s Death"},"content":{"rendered":"<p>While ideally a child\u2019s parentage is determined when they are young, that does not always occur.\u00a0 A Texas appeals court <a href=\"https:\/\/cases.justia.com\/texas\/tenth-court-of-appeals\/2022-10-21-00142-cv.pdf?ts=1655976076\" target=\"_blank\" rel=\"noopener\">recently<\/a> considered whether the trial court could adjudicate the parentage of an adult petitioner after the death of the putative father.<\/p>\n<h3>Adult Child Files Paternity Suit Against Father&#8217;s Estate<\/h3>\n<p>An adult petitioner filed suit against his mother, his alleged father, and the independent executor of his alleged father\u2019s estate, seeking adjudication of his parentage and a declaration that he was the alleged father\u2019s biological son and had the rights and privileges of a surviving child.\u00a0 The executor filed a motion to dismiss, arguing a suit to adjudicate parentage cannot be brought after the putative father\u2019s death.\u00a0 The trial court denied both the executor\u2019s and the petitioner\u2019s respective motions for summary judgment.<\/p>\n<h3>Trial Court Adjudicates Parentage<\/h3>\n<p>At trial, the executor moved for judgment, arguing that suits to adjudicate parentage do not survive the putative father\u2019s death pursuant to the Texas Family Code.\u00a0 The trial court denied the motion and adjudicated the putative father as the petitioner\u2019s father.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-holds-paternity-cannot-be-adjudicated-after-putative-fathers-death\/#more-2445\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>While ideally a child\u2019s parentage is determined when they are young, that does not always occur.\u00a0 A Texas appeals court recently considered whether the trial court could adjudicate the parentage of an adult petitioner after the death of the putative father.
