Fam. Code \u00a7 160.204. If a child has a presumed father, a suit to adjudicate the child\u2019s parentage may not be brought after the child\u2019s fourth birthday unless an exception applies.\u00a0 Tex. Fam. Code \u00a7 160.607.<\/p>\n<h3>Presumed Father Challenges Paternity Adjudication<\/h3>\n<p>A presumed father recently <a href=\"https:\/\/cases.justia.com\/texas\/thirteenth-court-of-appeals\/2022-13-21-00279-cv.pdf?ts=1649938994\" target=\"_blank\" rel=\"noopener\">challenged<\/a> a court\u2019s adjudication that another man was the child\u2019s father, arguing the suit was time-barred.\u00a0 The child was born in May 2014.\u00a0 The mother and her husband separated that October.\u00a0 The mother began cohabiting with the alleged father the following October. The mother and her husband divorced in August 2016.\u00a0 The divorce order provided for visitation by the husband of all four children born during the marriage.<\/p>\n<p>The mother and alleged father got married.\u00a0 The alleged father petitioned for adjudication of parentage after a DNA test showed a 99.96% probability he was Lucy\u2019s biological father.\u00a0 The mother\u2019s ex-husband conceded that the alleged father was likely the child\u2019s biological father based on the DNA test.\u00a0 He argued, however, that the alleged father was time-barred from seeking adjudication of parentage.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-finds-alleged-father-time-barred-from-adjudicating-paternity\/#more-2408\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Under Texas family law, a mother\u2019s husband is presumed to be the father of a child born during the marriage.\u00a0 This presumption can be rebutted by an adjudication of parentage or by a valid denial of paternity filed by the presumed father along with a valid acknowledgement of paternity filed by another person.\u00a0 Tex.
