Copy space..&#8221;<\/p><\/div>\n<p>A Texas Mediated Settlement Agreement (\u201cMSA\u201d) must generally include language that it is not subject to revocation, be signed by each party, and be signed by the party\u2019s attorney who is present at the time of execution. Tex. Fam. Code \u00a7 6.602(b). If the MSA meets these requirements, it is binding and the court must render a divorce decree adopting it. The judgment must be compliant with the agreement and must not substantively alter it. The parties may revise or repudiate the agreement before the divorce is rendered, unless the agreement is otherwise binding under another law. Tex. Fam. Code \u00a7 7.006.<\/p>\n<p>In a <a href=\"https:\/\/cases.justia.com\/texas\/thirteenth-court-of-appeals\/2022-13-20-00415-cv.pdf?ts=1648124635\" target=\"_blank\" rel=\"noopener\">recent case<\/a>, a former wife appealed a divorce decree, arguing the court erred in rendering judgment on a settlement after she revoked her consent.\u00a0 The parties had reached an agreement at mediation and signed an MSA, but only the husband\u2019s attorney\u2019s signature was on the document.<\/p>\n<h3>Wife Revokes Consent to MSA<\/h3>\n<p>The wife filed a revocation of consent and an objection to the entry of a final divorce decree.
