In a <a href=\"https:\/\/cases.justia.com\/texas\/thirteenth-court-of-appeals\/2022-13-20-00347-cv.pdf?ts=1643289862\" target=\"_blank\" rel=\"noopener\">recent case<\/a>, a maternal uncle and aunt appealed an order that required them to pay child support for their nephew.<\/p>\n<p>When the child was born, the child\u2019s biological mother asked her brother to act as the child\u2019s father.\u00a0 The brother signed an acknowledgment of paternity, birth certificate, and a verification of birth facts.\u00a0 The birth certificate listed the brother\u2019s wife as the mother.\u00a0 Initially, they all lived together, but the mother moved out following a falling out with the couple.<\/p>\n<h3>Mother Files Paternity Suit<\/h3>\n<p>In August of 2016, the mother petitioned to adjudicate parentage, asking the court to adjudicate her as the mother and an identified man as the father.\u00a0 The brother and his wife were named as parties, but they also intervened in the case, asking the court to name them the child\u2019s managing conservators and terminate the mother and alleged father\u2019s parental rights.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/challenging-a-texas-acknowledgment-of-paternity\/#more-2347\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Some families choose to resolve custody manners informally.\u00a0 When the parties are the biological parents, subsequent disputes can be resolved through a Texas custody case.\u00a0 When one party is not biological parent, however, resulting disputes may be more complex.
