however, in other cases, it can be somewhat more complex.\u00a0 In a recent case, a former wife <a href=\"https:\/\/cases.justia.com\/texas\/thirteenth-court-of-appeals\/2022-13-20-00118-cv.pdf?ts=1643289862\" target=\"_blank\" rel=\"noopener\">challenged<\/a> a trial court\u2019s handling of the former husband\u2019s retirement benefits after it concluded she had already received all of the benefits to which she was entitled.<\/p>\n<p>The parties had been married 22 years when they divorced.\u00a0 The wife was awarded 50% of the husband\u2019s Civil Service Retirement Benefits accrued as of the date of the decree\u2019s entry.\u00a0 The trial court signed a Qualified Domestic Relations Order (\u201cQDRO\u201d) authorizing payment of an interest in the husband\u2019s monthly annuity payments to the wife and stating that she was entitled to a survivor annuity.<\/p>\n<h3>Trial Court Enters Original QDRO<\/h3>\n<p>The parties began receiving the monthly annuity payments pursuant to the QDRO after the husband retired at the end of 2011.\u00a0 In March 2016, the husband moved to vacate the QDRO, arguing the wife was not entitled to a survivor\u2019s benefit under the decree but a premium was being deducted from his monthly benefit.\u00a0 He asked the court to amend the QDRO to match the property division in the divorce decree.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/ex-wife-entitled-to-ongoing-interest-in-ex-husbands-defined-benefit-retirement-plan\/#more-2342\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Retirement benefits are often subject to property division in a Texas divorce.\u00a0 In some cases, calculating the community interest is straight forward;
