Tex. Fam. Code \u00a7 153.135.\u00a0 Under Texas law, there is a rebuttable presumption that the standard possession order serves the child\u2019s best interests.\u00a0 Tex. Fam. Code \u00a7 153.252.\u00a0 A father recently <a href=\"https:\/\/cases.justia.com\/texas\/third-court-of-appeals\/2021-03-19-00475-cv.pdf?ts=1621599707\" target=\"_blank\" rel=\"noopener\">challenged<\/a> the divorce decree giving the mother the right to designate the child\u2019s primary residence and awarding him the standard possession order.<\/p>\n<h2>Trial Court Initially Awards Father Primary Custody<\/h2>\n<p>According to the appeals court\u2019s opinion, the parties\u2019 child was born about three months after they married in 2014.\u00a0 The parties separated in 2016 and the mother petitioned for divorce in March 2017.
