Fam. Code \u00a7 45.004(a).\u00a0 Generally, courts should only order a child\u2019s name change if it is needed for the child\u2019s \u201csubstantial welfare.\u201d\u00a0 A mother recently <a href=\"https:\/\/cases.justia.com\/texas\/third-court-of-appeals\/2020-03-19-00649-cv.pdf?ts=1597321107\" target=\"_blank\" rel=\"noopener noreferrer\">appealed<\/a> a court\u2019s denial of her petition to change her children\u2019s names from their father\u2019s surname to her maiden name.<\/p>\n<p>The parents divorced in 2011. \u00a0After allegations the father had abused the son in 2015, the mother had sole possession of both of the minor children. The mother petitioned in 2019 to change the children\u2019s last name to her maiden name.\u00a0 The children agreed to the change, but the father opposed it.\u00a0 He argued they had his name since they were born and that they could change their names on their own when they are adults.<\/p>\n<p>The mother testified she wanted to change the children\u2019s names because she had grown up with her maiden name.\u00a0 She said the children wanted to identify with her family\u2019s name \u201cto feel the closeness of [that] family.\u201d\u00a0 They had been using her name and wanted to legally change their names.\u00a0 She testified that her maiden name is well respected in the area and having that name would be important when the children became involved with the family businesses.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-denies-mothers-request-to-change-childrens-surname\/#more-1651\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A parent may want to change a child\u2019s name for a number of reasons.\u00a0 Texas family law allows a court to order the change of a child\u2019s name if doing so is in the child\u2019s best interest.\u00a0 Tex.
