{"id":1628,"date":"2020-07-13T07:30:11","date_gmt":"2020-07-13T12:30:11","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1628"},"modified":"2020-07-13T07:30:11","modified_gmt":"2020-07-13T12:30:11","slug":"texas-divorce-court-may-clarify-divorce-decree-that-omitted-amount-of-wifes-retirement-award","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-divorce-court-may-clarify-divorce-decree-that-omitted-amount-of-wifes-retirement-award\/","title":{"rendered":"Texas Divorce Court May Clarify Divorce Decree That Omitted Amount of Wife&#8217;s Retirement Award"},"content":{"rendered":"<p>In some Texas divorce cases, the parties are able to reach an agreement on property division.\u00a0 Such an agreement is treated as a contract, even when it is incorporated into a final agreed divorce decree.\u00a0 If there is an ambiguity, the agreement may be reformed to correct a mutual mistake or reflect the parties\u2019 intent.\u00a0 An ambiguity exists if the meaning is uncertain or could reasonably be interpreted in more than one way.\u00a0 To show there was a mutual mistake, a party must prove there was a definite agreement that was misstated in the contract due to a mistake of both parties.<\/p>\n<p>In a <a href=\"https:\/\/www.txcourts.gov\/media\/1448250\/11-18-00139-cv-gates-opinion.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">recent case<\/a>, a wife moved for clarification to correct the trial court\u2019s omission of the amount of her portion of the husband\u2019s military retirement.
