Fam. Code \u00a7 155.201.\u00a0 To contest a transfer, a party must timely file \u201ca controverting affidavit.\u201d\u00a0 The controverting affidavit must deny the \u201cgrounds for transfer exist . . .\u201d\u00a0 If the opposing party files a timely qualifying controverting affidavit, then there is a hearing.\u00a0 If no qualifying controverting affidavit is timely filed, the case must be transferred without a hearing.\u00a0 The transfer is mandatory if the elements are met, even when an enforcement action is pending.\u00a0 A mother recently <a href=\"https:\/\/www.txcourts.gov\/media\/1447983\/190667f.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">challenged<\/a> an enforcement order that was followed by a transfer order just two hours later.<\/p>\n<p>The mother was granted the exclusive right to designate the child\u2019s primary residence and to designate it in McLennan County.\u00a0 According to the appeals court\u2019s opinion, she had moved to McLennan County by the time the divorce decree was entered in April 2018.<\/p>\n<p>The father petitioned for enforcement of possession or access in June 2019 in Harris County, where the divorce decree had been issued.\u00a0 The mother moved to transfer venue based on a statute requiring a case to be transferred to the county where the child has lived for at least six months.\u00a0 Tex. Fam. Code \u00a7 155.201.
