{"id":1610,"date":"2020-06-15T08:00:10","date_gmt":"2020-06-15T13:00:10","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1610"},"modified":"2020-06-15T08:00:10","modified_gmt":"2020-06-15T13:00:10","slug":"texas-appeals-court-upholds-order-requiring-father-to-pay-mothers-attorneys-fees","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-upholds-order-requiring-father-to-pay-mothers-attorneys-fees\/","title":{"rendered":"Texas Appeals Court Upholds Order Requiring Father to Pay Mother&#8217;s Attorney&#8217;s Fees"},"content":{"rendered":"<p>When a party wants a judgment corrected, he or she generally has to challenge it directly within a specific time frame.\u00a0 In some cases, however, a person may seek to avoid the effect of the judgment through a collateral attack.\u00a0 A voidable judgment becomes final unless it is attacked directly in accordance with applicable procedural rules, but a void judgment may be challenged at any time.\u00a0 In a <a href=\"http:\/\/courtstuff.com\/opinions\/20200608\/180629opinion.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">recent case<\/a>, a Texas appeals court had to determine if a provision in a Texas divorce decree ordering a father to pay the mother\u2019s attorney\u2019s fees was void or voidable.<\/p>\n<p>The divorce decree included a fee provision that ordered the father to pay the mother\u2019s attorney\u2019s fees related \u201cto issues concerning the suit affecting parent-child relationship [\u201cSAPCR\u201d] and the safety and welfare of the children.\u201d<\/p>\n<p>The father moved to modify the decree about a month after it was signed.\u00a0 He asked for increased possession and decreased child support.\u00a0 He also challenged the fee provision.\u00a0 The court\u2019s order increased his possession.
