Tex. Fam. Code \u00a7 153.135. The court is also not required to award rights and duties of conservatorship to each parent equally or both jointly.\u00a0 The court\u2019s primary consideration should be the child\u2019s best interest. Tex. Fam. Code \u00a7 153.002.\u00a0 Case law has established a non-exhaustive list of factors to be considered in determining the child\u2019s best interest.<\/p>\n<p>A mother <a href=\"https:\/\/cases.justia.com\/texas\/first-court-of-appeals\/2020-01-18-00964-cv.pdf?ts=1587472431\" target=\"_blank\" rel=\"noopener noreferrer\">recently challenged<\/a> a court order naming both parents joint managing conservators, but granting the father the exclusive right to determine the child\u2019s primary residence.\u00a0 The mother petitioned for divorce and moved from Missouri City to Dallas.\u00a0 The child primarily lived with the mother for the next six years, but the parents sharing custody under temporary orders.<\/p>\n<p>According to the appeals court\u2019s opinion, both parents \u201ccontributed to the ongoing discord . . .\u201d The mother failed to tell the father about some appointments or events before they occurred.\u00a0 She sometimes kept the child from taking calls or made him stop conversations.\u00a0 She would not allow the father to have makeup time, but sought makeup time for herself when her time was disrupted by bad weather.\u00a0 The father \u201cberated\u201d the mother when she was late for the exchange, recorded their conversations, and tracked the child through an iPad.\u00a0 He sometimes ignored the mother, but criticized her frequently for not communicating with him.\u00a0 The mother testified the father was controlling and manipulative.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/best-interest-factors-may-not-be-relevant-in-texas-custody-case-where-both-parents-are-fit\/#more-1603\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a Texas custody case, the court is not required to give parents equal periods of possession or visitation just because it appoints the parents as joint managing conservators.
