The court may only change the child\u2019s name based on \u201cgood cause shown\u201d and the best interest of the child.\u00a0 \u00a0Some courts consider a showing of the child\u2019s best interest to be sufficient to establish good cause, but other courts require the requesting party to establish both.<\/p>\n<p>In a <a href=\"https:\/\/cases.justia.com\/texas\/eighth-court-of-appeals\/2020-08-18-00202-cv.pdf?ts=1588346317\" target=\"_blank\" rel=\"noopener noreferrer\">recent case<\/a>, the parents agreed on all issues except the child\u2019s name.\u00a0 According to the court\u2019s opinion, the mother told the father she was pregnant while they were dating.\u00a0 She broke up with him after he asked her to consider an abortion.\u00a0 She then got back together with an ex-boyfriend.\u00a0 She gave the child the boyfriend\u2019s first and last names, but called him by his middle name.\u00a0 The mother told the father he was actually the child\u2019s father after she broke up with the boyfriend.<\/p>\n<p>The father filed a petition to establish paternity, appoint him managing conservator, and change the child\u2019s name.\u00a0 The mother asked to be the sole managing conservator and receive child support.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-reverses-order-changing-childs-name\/#more-1588\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>When there is a finding of paternity, a child\u2019s father may move to change the child\u2019s name.\u00a0 Under Texas family law and the state constitution, both parents are treated equally, however, so a child\u2019s surname will not be changed to that of the father based solely on tradition.
