{"id":1540,"date":"2020-03-16T09:00:32","date_gmt":"2020-03-16T14:00:32","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1540"},"modified":"2020-03-16T09:00:32","modified_gmt":"2020-03-16T14:00:32","slug":"texas-appeals-court-upholds-custody-modification-following-alleged-domestic-violence-incident","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-upholds-custody-modification-following-alleged-domestic-violence-incident\/","title":{"rendered":"Texas Appeals Court Upholds Custody Modification Following Alleged Domestic Violence Incident"},"content":{"rendered":"<p>Texas custody orders may be modified if there has been a substantial and material change in circumstances of either of the parents or the child since the previous order.\u00a0 The petitioner must prove the circumstances at the time of the previous order as compared to the circumstances at the time of the modification hearing.\u00a0 Family violence may constitute a substantial and material change in circumstances.<\/p>\n<p>A father <a href=\"https:\/\/cases.justia.com\/texas\/third-court-of-appeals\/2020-03-19-00074-cv.pdf?ts=1584090934\" target=\"_blank\" rel=\"noopener noreferrer\">recently appealed<\/a> an order modifying custody of his daughter supported partly by an alleged incident of domestic violence.\u00a0 The agreed final divorce decree appointed both parents joint managing conservators with the father having the exclusive right to designate the child\u2019s primary residence.\u00a0 The mother petitioned to modify the order, alleging a material and substantial change in circumstances.\u00a0 She alleged there had been a recent family violence incident involving the father and his fianc\u00e9e.\u00a0 She also alleged he had a history or pattern of family violence.\u00a0 She asked that he be excluded from possession of their daughter.\u00a0 Alternatively, she requested he have only supervised visitation and that she be named as sole managing conservator or be given the right to designate the child\u2019s primary residence.<\/p>\n<p>The court entered temporary orders naming the parents temporary joint managing conservators and modifying the possession schedule.\u00a0 The temporary orders prohibited unrelated persons from being in the same residence as the child from 8 pm to 8 am.\u00a0 They required the mother to reside either at her parents\u2019 home or her own home.\u00a0 Finally, they ordered that neither parent would provide support to the other.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-upholds-custody-modification-following-alleged-domestic-violence-incident\/#more-1540\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Texas custody orders may be modified if there has been a substantial and material change in circumstances of either of the parents or the child since the previous order.\u00a0 The petitioner must prove the circumstances at the time of the previous order as compared to the circumstances at the time of the modification hearing.\u00a0 Family [&hellip;]<\/p>\n","protected":false},"author":2,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[23],"tags":[],"class_list":["post-1540","post","type-post","status-publish","format-standard","hentry","category-child-custody"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v25.7 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Texas Appeals Court Upholds Custody Modification Following Alleged Domestic Violence Incident &#8212;
