{"id":1529,"date":"2020-03-04T09:30:19","date_gmt":"2020-03-04T15:30:19","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1529"},"modified":"2020-03-04T09:30:19","modified_gmt":"2020-03-04T15:30:19","slug":"texas-court-denies-new-qualified-domestic-relations-order-more-than-20-years-after-divorce","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-denies-new-qualified-domestic-relations-order-more-than-20-years-after-divorce\/","title":{"rendered":"Texas Court Denies New Qualified Domestic Relations Order More Than 20 Years After Divorce"},"content":{"rendered":"<p>A court generally may not amend or change the property division made in a Texas divorce decree.\u00a0 The court may issue an order to enforce the property division, but such an order may only clarify the prior order or assist in its implementation.\u00a0 If a court improperly amends or modifies the substantive property division in the final divorce decree, it is acting beyond its power and that order is unenforceable. Tex. Fam. Code Ann. \u00a7 9.007.\u00a0 Qualified Domestic Relations Orders (QDRO) are separate orders that set forth the distribution of retirement plan assets.\u00a0 They are considered a type of enforcement or clarification order and cannot change the property division made in the divorce decree.<\/p>\n<p>In a <a href=\"https:\/\/cases.justia.com\/texas\/first-court-of-appeals\/2020-01-18-00803-cv.pdf?ts=1579180467\" target=\"_blank\" rel=\"noopener noreferrer\">recent case<\/a>, an ex-wife sought an additional QDRO years after the divorce was finalized.\u00a0 The couple divorced in 1995, and the parties have been in litigation for the past several years regarding the husband\u2019s retirement accounts.<\/p>\n<p>The divorce decree awarded the ex-wife 50% \u201cof any and all sums \u2026 related to any \u2026 retirement plan, pension plan, \u2026 or other benefit program existing by reason of [ex-husband\u2019s] past, present, or future employment, including without limitation, [ex-husband\u2019s] Retirement Fund, Provident Fund, and SPIF Fund with Shell Oil Company per Qualified Domestic Relations Orders \u2026\u201d\u00a0 The trial court signed a QDRO awarding the ex-wife half the funds in the ex-husband\u2019s Shell Provident Fund on the date of the divorce.\u00a0 The court found the total community property interest in the Shell Provident Fund was the total amount of contributions, interest, and earnings made or accrued by or on behalf of the ex-husband into any of the Shell Provident Fund accounts.\u00a0 The QDRO stated the ex-wife was \u201cdivested of all right, title, and interest in and to any balance remaining in any account of the Shell Provident Fund\u2026\u201d and that the fund would be discharged from all obligations to her when full payment was made pursuant to the QDRO.\u00a0 It also said it would become an integral part of the divorce decree.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-denies-new-qualified-domestic-relations-order-more-than-20-years-after-divorce\/#more-1529\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A court generally may not amend or change the property division made in a Texas divorce decree.\u00a0 The court may issue an order to enforce the property division, but such an order may only clarify the prior order or assist in its implementation.\u00a0 If a court improperly amends or modifies the substantive property division in [&hellip;]<\/p>\n","protected":false},"author":13,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[4],"tags":[],"class_list":["post-1529","post","type-post","status-publish","format-standard","hentry","category-divorce"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v25.7 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Texas Court Denies New Qualified Domestic Relations Order More Than 20 Years After Divorce &#8212;
