{"id":1442,"date":"2019-10-16T09:34:41","date_gmt":"2019-10-16T14:34:41","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1442"},"modified":"2019-10-16T09:34:41","modified_gmt":"2019-10-16T14:34:41","slug":"texas-court-includes-fathers-personal-injury-annuity-in-resources-when-calculating-child-support","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-includes-fathers-personal-injury-annuity-in-resources-when-calculating-child-support\/","title":{"rendered":"Texas Court Includes Father&#8217;s Personal Injury Annuity in Resources When Calculating Child Support"},"content":{"rendered":"<p>The Texas Family Code provides guidelines to assist courts in calculating child support that are based on a percentage of the parent\u2019s net monthly resources.\u00a0 The statute sets forth what types of income are included and excluded from the parent\u2019s net monthly resources.\u00a0 In many families, it is fairly straight-forward to determine what is included in the calculation.\u00a0 If a parent\u2019s only income is from the wage or salary he or she earns from employment, it is relatively simple to identify the net monthly resources.\u00a0 Some families, however, have more complicated financial circumstances making it less clear what should be included.<\/p>\n<p>In a <a href=\"https:\/\/cases.justia.com\/texas\/fourth-court-of-appeals\/2019-04-18-00551-cv.pdf?ts=1570623289\" target=\"_blank\" rel=\"noopener noreferrer\">recent case<\/a>, a father appealed the inclusion of an annuity payment in his net monthly resources for purposes of the child support calculation.\u00a0 Prior to the marriage, the father settled a claim for a work-related accident with his employer.\u00a0 As a result of the settlement, the father receives $6,970 per month from an annuity.\u00a0 The payments will continue until either the the father\u2019s death or June 1, 2044.<\/p>\n<p>The couple had one child during the marriage.\u00a0 The mother filed for divorce less than a year after the couple was married.\u00a0 Although the couple reached agreement on some issues, they were unable to agree on child support and medical support.\u00a0 The trial court found the annuity payments were \u201cresources\u201d under Texas Family Code 154.062 and included them in the father\u2019s resources when calculating the child and medical support payments.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-includes-fathers-personal-injury-annuity-in-resources-when-calculating-child-support\/#more-1442\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Texas Family Code provides guidelines to assist courts in calculating child support that are based on a percentage of the parent\u2019s net monthly resources.\u00a0 The statute sets forth what types of income are included and excluded from the parent\u2019s net monthly resources.\u00a0 In many families, it is fairly straight-forward to determine what is included [&hellip;]<\/p>\n","protected":false},"author":11,"featured_media":1445,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[16],"tags":[],"class_list":["post-1442","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-child-support"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v25.7 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Texas Court Includes Father&#039;s Personal Injury Annuity in Resources When Calculating Child Support &#8212;
