{"id":1435,"date":"2019-10-09T09:30:40","date_gmt":"2019-10-09T14:30:40","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1435"},"modified":"2019-10-09T09:30:40","modified_gmt":"2019-10-09T14:30:40","slug":"texas-appeals-court-upholds-permanent-injunction-prohibiting-contact-between-fathers-girlfriend-and-child","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-upholds-permanent-injunction-prohibiting-contact-between-fathers-girlfriend-and-child\/","title":{"rendered":"Texas Appeals Court Upholds Permanent Injunction Prohibiting Contact Between Father&#8217;s Girlfriend and Child"},"content":{"rendered":"<p>Generally, a permanent injunction is difficult to obtain and requires proof that certain requirements are met.\u00a0 In Texas child custody cases, however, a court may be able to issue a permanent injunction, even if those requirements have not been met, if it finds that the injunction is in the child\u2019s best interest.\u00a0 In a <a href=\"https:\/\/cases.justia.com\/texas\/sixth-court-of-appeals\/2019-06-19-00018-cv.pdf?ts=1570104931\" target=\"_blank\" rel=\"noopener noreferrer\">recent case<\/a>, a father appealed an injunction prohibiting him from allowing contact between his girlfriend and his child.<\/p>\n<p>The parents had agreed to temporary orders prohibiting any unrelated adult in a romantic relationship with one of the parents from spending the night in a home with the child.\u00a0 The temporary order also stated that the father\u2019s girlfriend would not be around the child while the father had possession.<\/p>\n<p>Following a mediated settlement agreement addressing all other issues, the trial court held a hearing to address this issue. The trial court granted an \u201cinjunction\u201d prohibiting contact between the father\u2019s girlfriend and the child without hearing evidence.\u00a0 The mother\u2019s attorney stated they had been unable to serve the father\u2019s girlfriend with notice of the hearing.\u00a0 The court indicated it was entering a \u201cpermanent morality clause\u201d based on the girlfriend not testifying.
